License Agreement

1. Preamble

This software connects engineering data and user inputs with an external Large Language Model (LLM). The software itself does not generate engineering data, but serves exclusively as an intermediary and integration tool. Use in industrial environments is potentially risky and requires expert handling.

By installing, activating, or using the software, the user fully accepts this agreement.

2. License Scope

The provider grants the licensee a non-exclusive, non-transferable, time-limited license to use the software on a single hardware instance (HW-ID).

The licensee receives no ownership of the software, only a right of use.

3. Restrictions

The licensee may not:

  • Decompile, reverse engineer, or modify the software
  • Transfer the license to other devices (except as per license model)
  • Resell or rent the software without written consent
  • Bypass security mechanisms, licenses, or activations
  • Use the software in safety-critical applications where malfunctions could endanger life, health, or significant assets

4. Use in Engineering Environments

The licensee expressly acknowledges:

  1. The software does not perform technical validation of content generated by the connected LLM.
  2. All generated content must be completely, professionally, and manually reviewed by qualified personnel.
  3. The software may not perform automated write operations on productive control projects.
  4. The user bears sole responsibility for the interpretation, application, and integration of all content mediated by the software.

5. Liability for External LLM Content

The software merely provides the connection to an external LLM. The provider has no influence on:

  • Quality, accuracy, or completeness of LLM outputs
  • Possible misinterpretations
  • Hallucinations or erroneous code suggestions
  • Functional unsuitability of generated content

Any liability of the provider for damages arising from the use or expectation of use of content generated by an LLM is excluded.

6. Limitation of Provider Liability

The provider's liability is limited in any case – regardless of legal basis – as follows:

  • Maximum up to the amount of the license fee paid by the licensee
  • No liability for indirect damages
  • No liability for production downtime
  • No liability for data loss
  • No liability for lost profits
  • No liability for consequential damages arising from engineering errors
  • No liability for damages resulting from improper or negligent use

This limitation applies even in the case of foreseeable damages.

7. User Qualification

Use of the software is permitted only to persons who:

  • Have sound knowledge of PLC programming
  • Are trained TIA Portal users
  • Can professionally assess engineering changes
  • Can assess risks when dealing with automatically generated suggestions

By using the software, the user confirms meeting these qualifications.

8. Technical Safety Mechanisms

The software implements technical safeguards, including:

  • Manual confirmation before adopting any external content
  • No automatic writing to productive projects
  • Warnings with every LLM-generated output
  • Audit logs documenting user actions

The user may not disable or bypass these protective mechanisms.

9. Updates & Changes

The provider may provide updates but is not obligated to provide support, further development, or functional guarantees.

10. Data Protection

The software may forward local engineering data to an external LLM for processing. The user is solely responsible for compliance with internal security and confidentiality guidelines as well as applicable data protection regulations.

11. Term & Termination

Subscription Licenses: For time-limited subscription licenses (Professional, Enterprise):

  • The license runs automatically for the chosen period (monthly/yearly)
  • Renewal occurs automatically unless cancelled before expiration
  • Cancellation is possible at any time via the Stripe Customer Portal
  • After expiration without renewal, the software is deactivated
  • A 30-day trial version is available

Basic License (free):

  • Unlimited duration
  • Limited functionality
  • Can be upgraded to Professional/Enterprise at any time

Violation of EULA: If this agreement is violated, the license expires automatically. In this case, the user is obligated to uninstall the software immediately.

12. Jurisdiction & Applicable Law

Swiss law applies exclusively. Jurisdiction is the registered office of the provider company.

13. Severability Clause

If individual provisions are invalid, the rest of the agreement remains valid.

14. Acknowledgment

By installing, activating, or using the software, the user confirms that they:

  • Have fully understood this EULA
  • Have recognized all risks
  • Assume full responsibility for use
